Traffic accident handling instructions
XNUMX. Preface
[What is a "road traffic accident"? 】
"Road traffic accident" refers to an accident in which a vehicle or powered machinery travels on the road, causing injury or death, or causing damage to vehicles, powered machinery, or property.
[How to report a crime? 】
(1) The simplest and fastest way to report an accident is to immediately dial the "110" police report hotline to report the incident.
(2) When reporting a crime, information such as the location, time, vehicle number, vehicle type, casualties, and name of the person reporting the accident should be stated.
(3) After reporting the crime, you should wait at the scene for the handling personnel to arrive at the scene.
(4) If the person concerned reports the crime in person and accepts the police's handling, it is an act of "surrendering". Those who bear criminal responsibility may have their sentences reduced in accordance with the law.
2. On-site processing
[How to deal with minor accidents? 】
(62) In the event of an accident in which the vehicle is slightly damaged and can still drive and no one is injured or killed, the four corners of each vehicle, the semicircle of the two tires of the locomotive (slow vehicle) and the handlebar area should be plotted on the ground. , quickly move the vehicle to the side of the road without obstructing traffic to avoid penalties. (According to Article 2, Item 600 of the Road Traffic Management Punishment Regulations, the penalty is NT$1800 to NT$XNUMX)
(2) If the parties involved settle the matter on their own on the spot, they do not have to call the police to deal with the matter, but they should clearly state the contents of the settlement in writing to avoid further disputes later.
(3) If the parties concerned are unable to settle the matter on their own, please call the police immediately and are not allowed to leave the scene alone.
[How to deal with casualties? 】
(1) Rescue the injured as soon as possible and send the injured to first aid quickly.
(2) Place warning signs at appropriate distances at both ends of the accident site to protect the scene, and do not arbitrarily move the accident vehicle and on-site evidence. However, all parties involved agree that when moving a vehicle, the location of the vehicle and on-site evidence should be mapped first, and then the vehicle should be moved to a place that does not obstruct traffic.
(3) You should call the police immediately and do not leave the scene alone to avoid the other party reporting the hit-and-run incident.
[How to deal with a hit-and-run accident? 】
(1) In case of a hit-and-run accident, you should keep evidence of the scene and call the police immediately.
(2) Eyewitnesses should be sought and information provided such as the number, type, color, characteristics, and direction of escape of the vehicle involved in the accident to facilitate the police investigation.
[How to protect your own rights and interests? 】
(1) The parties concerned may voluntarily go to the Traffic Police Brigade Joint Service Center (26F, No. 1, Aiguo West Road, Zhongzheng District, Taipei City) during office hours to inquire about the preliminary analysis and judgment results one month after the accident.

Participation and handling of liability for accidents
[How to deal with criminal liability? 】
(6) If someone is injured in the accident and the parties are unable to reconcile, please take the initiative to file a complaint with the investigation team of the branch or the local court within 6 months of the accident. If the legal period of XNUMX months is exceeded, the rights and interests will be lost.
(2) If someone died in the accident, since it is a non-complaint case, the prosecutor will initiate a public prosecution in accordance with the law, and the parties concerned should wait for notification from the local court.
[How to deal with civil liability? 】
Parties involved in civil claims should coordinate their own claims or entrust an insurance company to handle the matter. If a settlement cannot be reached, they should apply for mediation directly to the mediation committee of the local office where the accident occurred or where the opposite party lives, or to the local court for a hearing. The statute of limitations for civil compensation claims begins when the accident occurs and the person with the obligation to pay compensation becomes aware of the damage. It will expire if it is not exercised within 2 years. Special attention should be paid to this.
